anti - corruption

Compliance counseling

Our partners have been advising clients on the U.S. Foreign Corrupt Practices Act (FCPA) since 1989. Almost since that time, we have been helping clients win and maintain government contracts and services without submitting to extortion attempts by wayward government functionaries.

Training workshops

In addition to stepping into difficult situations to negotiate directly on behalf of clients with government officials, we now provide training workshops at the local and international home-office levels on how to deter extortion situations.

Furthermore, based on in-depth studies and practical experience, we can now train client employees, and subsidiary, joint venture, and distributor employees and agents on how to fend off extortion demands without having to walk away from the negotiating table.

Anti - Corruption Expert Bruce Horowitz

Bruce Horowitz, who leads this area for the firm, has been providing FCPA training in the USA and Ecuador to lawyers, paralegals, law students, accounting professionals, and anti-corruption professionals since 1996.

Stuart Deming, the author of the international practitioner’s desk book, The Foreign Corrupt Practices Act and the New International Norms (2005, ABA), has written:

"Bruce Horowitz is one of those rare experts with an expertise as to how to successfully operate in what are often perceived as challenging environments in terms of corruption … while his expertise relates largely to Latin America; many of his insights may have applicability in other parts of the world. Any company that is engaged in international business, particularly in Latin America, is well advised to seek Bruce Horowitz out. While there is no easy answer to the problems that can arise, his insights and guidance can prove very useful in working through the seemingly intractable problems that can arise."

Mr. Horowitz is an active member of the American Bar Association’s International Section Committee on Anti-corruption Initiatives & Compliance Issues, as well as the Co-Chair of the U.S. Lawyers Abroad Committee, and Vice-Chair of the Latin American and Caribbean Committee. Mr. Horowitz has also taught Comparative Anti-Corruption Law at three universities in Ecuador. His post-graduate thesis is on the applicability, for lawyers, of negotiation theory and techniques in situations of public extortion.
